These Terms of Service ("Terms") govern your access to and use of maker305.com and our 3D printing and custom 3D print services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Company Information
Maker305 is a 3D printing and curated gadgets business based in Miami, Florida, USA. References to "Maker305", "we", "us", or "our" refer to the owner and operator of the Maker305 website and Services.
2. Eligibility and Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and place orders through our site. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Orders, Pricing, and Payment
When you place an order, you are offering to purchase products or services subject to these Terms. All orders are subject to availability and our acceptance.
- Prices are listed in U.S. Dollars unless otherwise indicated and may be subject to sales tax or other applicable charges based on your location.
- We reserve the right to change prices at any time, but changes will not affect confirmed orders for which payment has already been made.
- Payment is processed by third-party providers (such as Stripe). You authorize us and our payment providers to charge your chosen payment method for the total amount of your order, including any applicable taxes and shipping.
- In the case of custom 3D print jobs, we may provide a custom quote based on your files and specifications. Your order will not be produced until you have reviewed and approved the quote.
4. Custom 3D Print Jobs
Our custom 3D printing Services involve manufacturing physical objects based on digital files and instructions that you provide.
- You are solely responsible for ensuring that you have all necessary rights and permissions to use, upload, and request printing of any 3D models, designs, or other content you provide.
- You agree not to upload or request printing of any content that is illegal, infringing, dangerous, or otherwise prohibited by law (including but not limited to weapons or components designed for harm, or content that infringes third-party intellectual property rights).
- We reserve the right, in our sole discretion, to refuse any order or file that we believe violates these Terms or applicable law.
- Minor variations in color, surface finish, or dimensions may occur due to the limitations and tolerances of 3D printing technologies. These normal variations do not constitute defects.
5. Intellectual Property
As between you and Maker305:
- You retain any intellectual property rights you hold in the 3D models and designs you upload.
- By uploading content and requesting printing, you grant Maker305 a limited, non-exclusive, royalty-free license to use, reproduce, and modify your content solely for the purpose of evaluating, quoting, manufacturing, and delivering your order.
- Our website, branding, content, and original product designs are protected by intellectual property laws and may not be used without our prior written permission.
6. Shipping, Risk of Loss, and Delivery
We will ship orders to the address you provide at checkout. Any delivery dates are estimates and not guaranteed.
- Risk of loss and title for physical products pass to you upon our delivery of the products to the carrier.
- You are responsible for providing accurate shipping information. We are not liable for delays or losses caused by incorrect or incomplete addresses.
7. Returns, Cancellations, and Refunds
Maker305 currently serves individual consumers (B2C). For most non-custom, stocked products, you may request a return within thirty (30) days of delivery, provided the item is unused, in its original condition, and in the original packaging, unless a different return policy is stated on the product page at the time of purchase.
Because many of our products, especially custom 3D prints, are produced to your specifications, custom-made or personalized items are generally not eligible for return or refund unless there is a clear manufacturing defect or we have otherwise agreed in writing.
- If you believe there is a defect or issue with your order, you must contact us within thirty (30) days of delivery with photos and a description of the problem so we can evaluate the situation.
- We may, at our discretion, offer a reprint, replacement, or refund for confirmed defects.
- Custom orders that are already in production may not be cancelled.
8. Prohibited Uses
You agree not to use the Services for any unlawful or prohibited purpose, including but not limited to:
- Violating any applicable local, state, national, or international law.
- Uploading or requesting the manufacture of weapons or items designed to cause harm.
- Infringing or misusing third-party intellectual property rights.
- Attempting to interfere with or compromise the security of the Services.
9. Disclaimers
To the fullest extent permitted by law, the Services and all products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.
10. Limitation of Liability
To the maximum extent permitted by law, Maker305 and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of (or inability to use) the Services or products.
Our total liability for any claim arising out of or relating to the Services or products will not exceed the amount you paid for the order giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Maker305 and its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Services, your content or designs, or your violation of these Terms or applicable law.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Florida and the United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms, the Services, or products will be brought exclusively in the state or federal courts located in or serving Miami, Florida, and you consent to the jurisdiction of such courts.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms.
